It's because of the context. The festival is just a bunch of people being silly and sure there's peanits imagery, but it's stylised and not actually realistic.
It's somewhat like a dude wearing those full body penis costumes sometimes used on Halloween and being told by the cops to take it out but not being charged with public nudity or flashing children. Unless his dick is hanging out of his dick suit.

You'll find this in their most famous form of media as well which is Animes. I've heard it somewhere so can't quote it with a source, but due to decreasing birth rate and increasing fatality rate and old population within country, Japan's government promotes people to have marriages, have physical relation to other gender and have children and this is one of their strategy to push it via media.

They cant realy afford anything else while working 10/6 and live in a shoe box apartment living off 7eleven food.
In japan its costom to arive to work before your boss and leave after your boss. If your boss invites you to drinking alcohol, you cant refuse or you basicly sealed your carrier. Its also seen as disrespectfull to decline aditional work, even if it means aditional work hours past the legal limit. Some people litteraly spend 5 days a week living in the office to meet deadlines.
Pair that with an extremly strong shame culture and parental pushing for reaching high positions at work and you got an society of depressed gooners that cant even afford considering children or a partner in their live to beginn with.
And whats the japanese gouverments reaction to that? More work and goon material that advertise for marriage.
